Agreement
These Terms of Service govern your use of brincore.com and any services provided by Brincore LLC, a Texas limited liability company ("Brincore," "we," "us," or "our"). By accessing this website or engaging our services, you agree to these terms. If you do not agree, please do not use this website or our services.
Services
Brincore provides software consulting, design, and development services including but not limited to: AI application development, mobile application development, product management and discovery, workflow automation, managed hosting, and ongoing support. The specific scope, deliverables, timeline, and pricing for any engagement are defined in a separate written proposal or statement of work agreed upon by both parties before work begins.
Client Ownership
Upon receipt of full payment for an engagement, the client owns all work product delivered by Brincore, including source code, designs, documentation, and any other deliverables specified in the project agreement. Brincore does not retain any ownership interest in work product delivered to clients. Third-party software, libraries, or platforms used in the delivery of services are subject to their own licensing terms.
Payment
Payment terms are specified in each project proposal. Brincore offers both fixed-price and time-and-material engagements. Fixed-price projects typically require a deposit before work begins, with the balance due upon delivery. Time-and-material projects are invoiced on a schedule agreed in the project proposal. Work may be paused on accounts with outstanding invoices past 30 days.
No Guarantee of Business Outcomes
Brincore builds software to client specifications. We do not guarantee specific business outcomes, revenue results, user adoption rates, or return on investment from the software we build. The success of any application or system depends on many factors outside our control, including but not limited to market conditions, client execution, user behavior, and third-party platform performance. Our commitment is to deliver what is specified in the project agreement, built to a professional standard.
Confidentiality
Brincore treats all client business information as confidential. We will not disclose your business processes, technical specifications, or proprietary information to third parties without your written consent, except as required by law. Clients may request a separate Non-Disclosure Agreement before sharing sensitive information.
Website Use
You may use brincore.com for lawful purposes only. You may not use this website to transmit spam, conduct automated scraping, attempt to gain unauthorized access to any system, or engage in any activity that could damage, disable, or impair the website or its infrastructure.
Intellectual Property
The Brincore name, logo, website content, and marketing materials are the property of Brincore LLC. You may not reproduce, distribute, or use them without written permission, except to share links to the website or reference Brincore in a factual context.
Limitation of Liability
To the maximum extent permitted by applicable law, Brincore LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or business interruption, arising out of or related to the use of this website or our services. Our total liability for any claim arising from our services shall not exceed the amount paid by the client for the specific engagement giving rise to the claim.
Governing Law
These Terms of Service are governed by the laws of the State of Texas, without regard to its conflict of law principles. Any disputes arising from these terms or our services shall be resolved in the courts of Tarrant County, Texas.
Changes to These Terms
We may update these Terms of Service from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of the website after any changes constitutes your acceptance of the updated terms.
